HP unlawfully blocks third party cartridges by pushing firmware update

Euroconsumers and its members asked HP Inc. to pay damages to consumers in Italy, Belgium, Spain, Portugal and Brazil for the failed compatibility of its printers with third-party cartridges. Euroconsumers has also asked HP to immediately stop this misleading, detrimental and anticompetitive practice.

Since at least the end of 2016, HP has promoted that its printers were compatible with third-party cartridges while in practice they were not. Following a firmware update, users received an error message when installing third-party cartridges on HP printers. This error message led users to believe the perfectly good third-party cartridge was defective and forced them to purchase more expensive HP ones, or even replace their printer entirely. This HP practice linked to planned obsolescence is not only illegal, it is also irresponsible. It causes financial detriment to consumers and willfully increases the volume of waste when we should put all efforts on reducing it.

This is why Euronconsumers and its members requested HP to compensate each HP printer owner in Italy, Belgium, Spain, Portugal and Brazil affected by these practices with an amount of up to EUR 150, just like they did in the United States. The successful Euroconsumers’ agreement with HP puts consumers first, and ensures consumers that owned certain HP printers which had Dynamic Security installed will be compensated.

What is “Dynamic Security”

Dynamic Security is a technology that HP places in certain printers and which HP states it uses to protect the quality of its customer experience, maintain the integrity of its printing systems, and protect its intellectual property. Euroconsumers alleged that consumers were not properly informed that Dynamic Security would cause printers to reject certain non-HP replacement ink cartridges equipped with non-original chips or electronic circuitry.

What was agreed?

Euroconsumers and HP have agreed that the two parties will not proceed any further with legal actions. The agreement cannot be considered as an acknowledgement of any fault or wrongdoing by HP nor as an acknowledgement by Euroconsumers of the groundlessness of its claims. Rather, it is a sign of the commitment of both parties to work for the benefit of consumers. Under the agreement reached between HP and Euroconsumers, HP has agreed to establish a fund of up to USD 1,350,000 for payment of compensation to certain HP printer owners for losses allegedly suffered as a consequence of being unaware that their printers were enabled with Dynamic Security, which would limit their printers’ functionality when using third party cartridges with non-HP chips or circuitry. Consumers in Belgium, Italy, Spain and Portugal are eligible to receive settlement compensation from the fund if they own or owned certain HP printer models listed between September 1, 2016, and November 17, 2020.
